Is AI Photo Editing Legal for Real Estate Listings? MLS Rules in 2026

AI editing tools are legal for real estate photography in every US state. But since January 1, 2026, California AB 723 changed what you must disclose. If you use sky replacement, virtual staging, or object removal on listing photos, you now have specific legal obligations. Here's what the law requires and how to stay compliant.

What AB 723 requires

California Business & Professions Code § 10140.8 (AB 723) took effect January 1, 2026. For any listing image digitally altered to add, remove, or change physical features of the property:

  1. Label it clearly. A conspicuous disclosure near the image: "Digitally Altered," "Virtually Staged," "AI Enhanced," or similar.
  2. Provide the original. The unaltered image must be available via direct link, URL, or QR code. On websites you control, post it directly or link it.

This applies to brokers, agents, salespeople, and anyone acting on their behalf, including photographers and marketers. It covers MLS listings, personal websites, social media, portals, and virtual tours. There is no carve-out for Instagram or Facebook.

What needs disclosure vs what is exempt

Requires disclosure

  • Sky replacement
  • Virtual staging / furniture addition
  • Object or clutter removal
  • Greening grass / landscaping changes
  • Removing snow, cords, or imperfections
  • Adding pool water
  • Digitally turning on lights
  • Changing paint colors or finishes

Exempt (no disclosure)

  • Brightness and exposure correction
  • White balance / color correction
  • Contrast and sharpening
  • Cropping
  • Straightening / perspective correction
  • HDR blending (exposure fusion)

The distinction: does the edit make the property appear different from how it actually is? Exposure and color correction do not. Sky swaps and staging do.

How BMGENIE helps you stay compliant

BMGENIE keeps your original photo on file separately from every enhanced version. When you order sky replacement or virtual staging, the unaltered original is always available in your workspace for MLS upload or disclosure linking. Standard enhancements (HDR blending, exposure, color correction) fall under the exempt category and need no disclosure.

Frequently asked questions

Is AI photo editing legal for real estate listings?

Yes. AI photo editing is legal in every US state. However, certain enhancements like sky replacement, virtual staging, and object removal may require disclosure depending on your MLS board or state. California AB 723 (effective January 1, 2026) made disclosure mandatory for digitally altered images in sale advertising statewide.

What does California AB 723 require?

Any listing image digitally altered to add, remove, or change physical features must carry a conspicuous disclosure (such as "Digitally Altered" or "Virtually Staged") and the unaltered original must be made available via link, URL, or QR code. Violations are treated as deceptive advertising under California Real Estate Law.

Which photo edits do NOT require disclosure?

Basic enhancements that do not alter the property itself: brightness, contrast, white balance, cropping, straightening, sharpening, and exposure correction. These refine the image without misrepresenting the property.

Which edits DO require disclosure?

Sky replacement, virtual staging, object or clutter removal, greening grass, removing snow or cords, adding pool water, turning on lights digitally, changing paint colors, altering landscaping, and any edit that makes the property appear different from reality.

What are the penalties for non-compliance?

MLS boards may impose fines, warning letters, or suspension of MLS access for misleading photos. State complaints can trigger DRE investigation or license action. AB 723 violations are handled under California's existing deceptive advertising framework for real estate.
